Terms of Service
Effective date: August 21, 2026
These Terms of Service (“Terms”) are an agreement between you and Xaere SARL, operator of ZipQuantum (“ZipQuantum”, “we”, “us”). They govern your access to zq.tn, the ZipQuantum platform and API, Smart Links, domains, analytics, and related services (the “Service”). By creating an account, purchasing a plan, using the API, or creating or managing a Smart Link, you agree to these Terms.
1. Eligibility and authority
You must be at least 18 years old and legally able to enter into these Terms. If you use the Service for an organisation, you confirm that you are authorised to bind it. Consumer rights that cannot lawfully be waived remain unaffected.
2. Your account
You must provide accurate information, keep credentials and API keys confidential, and promptly notify us of suspected unauthorised access. You are responsible for activity performed through your account and for configuring appropriate access to your workspace.
3. The Service
ZipQuantum provides server-side Smart Link routing using web redirects, Apple Universal Links, Android App Links, and related platform mechanisms. Features and limits vary by plan and may include managed addresses, custom domains, APIs, analytics, QR entry points, and support. You are responsible for your own applications, store listings, destination availability, platform configuration, and testing.
4. Your links, domains, and content
You retain ownership of content and configuration you submit. You grant us a limited, worldwide, non-exclusive licence to host, copy, route, display, and otherwise process that material solely to provide, secure, and support the Service. You confirm that you control or are authorised to use every destination, domain, app identifier, image, parameter, and other material connected to your account.
5. Acceptable use
You may not use the Service to:
- break the law or infringe intellectual-property, privacy, publicity, or other rights;
- deliver malware, phishing, spam, deceptive redirects, fraud, harassment, or harmful content;
- impersonate others or misrepresent a link’s source or destination;
- bypass platform policies, consent requirements, access controls, rate limits, or plan limits;
- probe, disrupt, overload, reverse engineer, or compromise the Service except where applicable law expressly permits it; or
- resell or provide the Service to third parties unless your plan or a separate written agreement allows it.
We may block a link or suspend an account when reasonably necessary to address a security, legal, abuse, or platform-integrity risk.
6. Plans, billing, and cancellation
Plan features, quotas, prices, currency, taxes, and billing periods are shown before purchase. Subscriptions renew for the selected period until cancelled. You may cancel future renewal through the available billing controls or by contacting support. Cancellation takes effect at the end of the current paid period unless we state otherwise. Except where law requires a refund, amounts already paid are non-refundable and unused time or capacity has no cash value. Stripe processes card payments under its own terms.
7. Third-party services
The Service may depend on app stores, domain registries, DNS, hosting, payment, email, and other third-party services. Their terms apply separately. We are not responsible for third-party products, policy changes, outages, or a destination controlled by you or another party.
8. Availability and changes
We aim to provide a reliable and secure Service, but we do not promise uninterrupted or error-free operation. We may maintain, modify, or discontinue features and may introduce reasonable limits to protect security or performance. When practical, we will give advance notice of a material change that adversely affects a paid plan.
9. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access for a material breach, non-payment, legal requirement, security risk, or abusive use. Where appropriate, we will provide notice and a reasonable opportunity to cure. After termination, links may stop resolving and access to account data may end; provisions that by nature should survive will remain in effect.
10. Intellectual property
ZipQuantum and its software, branding, documentation, and service design are owned by us or our licensors. Except for the limited right to use the Service under these Terms, no intellectual-property rights are transferred to you. Feedback may be used without restriction or obligation.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that a link, platform integration, analytics result, or third-party service will always be available, accurate, or compatible.
12. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. Our total liability arising from the Service will not exceed the amount you paid to ZipQuantum for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot lawfully be limited.
13. Governing law and disputes
These Terms are governed by the laws of Tunisia, without regard to conflict-of-law rules. The courts of Tunis have jurisdiction, subject to any mandatory consumer-protection or jurisdiction rights that apply where you live. Before filing a claim, please contact us so we can try to resolve the issue informally.
14. Changes to these Terms
We may update these Terms to reflect changes to the Service, law, or risk. We will post the revised Terms with a new effective date and provide additional notice of material changes when appropriate. Changes apply prospectively. If you do not agree, you must stop using the Service before the revised Terms take effect.
15. General
These Terms, the Privacy Policy, and any applicable order or written addendum form the agreement for the Service. If a provision is unenforceable, the remainder stays in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganisation, merger, acquisition, or sale of assets.
